CLIENT AGREEMENT AND REFUND POLICY

The person purchasing and enrolling in any service with Griffin Coombs (hereby referred to as the “Instructor”) and/or The North Star Body will hereby be referred to as the “Client.” The Client hereby acknowledges that the purchase of this program, package, or subscription indicates his/her/their commitment to participate in the process and follow it through to its conclusion. If the Client is opting for a subscription or payment plan, the Client's submission of this form indicates his/her/their agreement to be automatically charged the price advertised for the exact number of installments advertised for the payment plan or subscription the Client purchases.

The Client acknowledges and accepts that all purchases are non-refundable. Refunds and cancellations may be considered on an individual basis, at the sole discretion of the Instructor. We ask that the Client be committed and honest, and we resolve to offer empathy and understanding at our discretion when warranted.

In general, the following guidelines apply to refund or cancellation requests.

  • Once an order is placed, there are no refunds.

  • Once an appointment is scheduled by the client or by the coach, it is considered a fixed appointment. However, if necessary, the Client may request to reschedule a session no less than 24 hours in advance using their Client scheduling confirmation page, or by contacting the Instructor via a pre-established means of communication.

  • Any missed sessions or sessions cancelled with less than 24 hours advance notice will be forfeited by the Client. Exceptions may be made for extenuating circumstances at the discretion of the coach.

  • The Client is responsible for completing all required forms and waivers that may be sent to him/her/them after booking. Failure to complete intake forms and liability waivers prior to the first scheduled session may result in a forfeited session. Griffin Coombs and The North Star Body assume no responsibility for loss of session time or session quality if required forms are submitted less than 24 hours before the scheduled appointment time.

  • If the Client requests a refund or cancellation due to extenuating circumstances, the Client must have attended all coaching calls, completed all program action items and/or assignments, and corresponded a minimum of twice weekly with the coach via text, email, or online messaging platform in order for the request to be considered.

  • If the Client has chosen a monthly payment plan or subscription and chooses not to continue the program for any reason, the Client will forfeit any remaining coaching sessions and assumes full liability for the amount owed for the entire program or subscription. The Client will continue to be automatically charged for the agreed upon amount of installments of the price advertised for said payment plan or subscription.

Refund or cancellation requests deemed unreasonable will not be considered. Unreasonable requests include, but are not limited to the following reasons:

  • Buyer’s remorse or the Client regretting the purchase after making it.

  • The Client’s inability or unwillingness to make time to participate in the program.

  • The Client’s decision to prioritize a different program or endeavor after purchasing this program.

  • The Client’s assertion that, after purchasing, they no longer require the guidance that the program offers.

The Client acknowledges that the Instructor reserves the right to terminate the coaching relationship with the Client at any time and for any reason. In the event that coaching services are terminated by the Instructor, the Client will be entitled to a refund for no more than the amount equal to the coaching services not yet rendered at the time of termination. If the Client has purchased a program or subscription and coaching services are terminated by the Instructor, any automatic charges will cease effective the day of termination. Under no circumstances is the Client entitled to a refund for services already rendered.


CLIENT AGREEMENT ACKNOWLEDGEMENT

Upon enrolling in services and submitting payment, you are hereby agreeing to assume the role of the Client as per the terms of the preceding Client Agreement, and affirm my full and complete acknowledgement, understanding, and consent to all terms and conditions outlined therein.

WAIVER OF LIABILITY

The person purchasing and enrolling in any service with Griffin Coombs and/or The North Star Body will hereby be referred to as the “Client.” By digitally signing this form, the Client acknowledges that he/she/they has read, understands, and fully agrees to the following disclaimer. The Client understands that Griffin Coombs (referred to hereby as the "Instructor") is not a registered medical practitioner. No advice or activity presented, demonstrated, or advised during any sessions with the Instructor are in any way intended as a substitute for a medical consultation, and should not replace or interfere with any guidance offered by a medical professional.

The Client acknowledges that participation in any service, session, program, package, or subscription may include activities recommended by the Instructor to be completed at home by the Client under no direct supervision, including but not limited to written recommendations, exercise tutorials, exercise videos, audio recordings, nutritional guidelines, and sleep guidelines. The Client assumes all physical, mental, emotional, and legal liability for all risks associated with the aforementioned activities, and any and all risks that may be associated with the session, program, package, or subscription in which the Client enrolls. The Client is free to stop activity during any session at any time, and for any reason. If at any time during any session, the Client feels the need for any assistance, medical or otherwise, the Client agrees to cease activity and notify the Instructor immediately. The Client takes full responsibility for responding to the Client's own needs, including stopping the session and obtaining appropriate care on his/her/their own. If the Client fails to seek the required medical care or ignores medical advice, and/or professional safety advice from the Instructor, the Client agrees to do so at the Client's sole risk.

The Client agrees not to participate in this program if the Client is pregnant or believes he/she/they may be pregnant.

The Client recognizes that exercise carries inherent risk to the musculoskeletal system (e.g. sprains, strains, accidental impact) and the cardiorespiratory system (e.g. dizziness, discomfort in breathing, heart attack). The Client hereby certifies that he/she/they know of no medical issue that would increase the Client's risk of illness, injury, or death as a result of participation in a regular exercise program.


ACKNLOWLEDGEMENT & AGREEMENT TO WAIVE LIABILITY

By enrolling in services and/or submitting payment, the Client understands that he/she/they is personally responsible for the Client's own actions during his/her/their participation in this program, package, or subscription, and that the Client waives the responsibility of Griffin Coombs and The North Star Body if the Client should incur any injury, illness, or disease as a result of the Client's participation in any session, service, program, package, or subscription.

The Client hereby confirms that he/she/they has carefully read this disclaimer and has fully understood that this is a release of liability. The Client hereby expressly agrees to release and discharge Griffin Coombs and The North Star Body from any and all claims or causes of action and agrees to waive any right that the Client may otherwise have to bring a legal action against the aforementioned individuals or companies for personal injury and/or damage to property.

Misc. Terms and Conditions

The following terminology applies to this agreement: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the these terms and conditions. “The Business,” “the Company,” “The North Star Body,” “Griffin Coombs,” “Ourselves,” “We,” “Our,” and “Us,” refers to our business, The North Star Body and the coach providing services, Griffin Coombs. All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of the United States. Any use of the above terminology or other words in the singular, plural, capitalization and/or, he/she, or they, are taken as interchangeable and therefore as referring to same.

This policy shall apply to all services available on the website: http://thenorthstarbody.com.

Once an order is submitted, the Client may not cancel the order. If the client believes there are extenuating circumstances, the Client may send a request to cancel to support@thenorthstarbody.com, clearly stating their request to cancel and the reason for said cancellation. All refund requests are at the discretion of Griffin Coombs and The North Star Body, and a refund request does not guarantee a refund or exchange of any kind to the Client.

In the event that the client purchases multiple sessions as part of a package or bundle, the client must redeem all individual sessions included the package or bundle within 180 days of initial purchase. All sessions not redeemed within 180 days will be forfeited by the client.

In the case that a refund is issued, reimbursement will be provided by the best available method, based on the Client’s situation and at the discretion of Griffin Coombs and The North Star Bidy. A 5% transaction fee of the refund amount will apply and will be subtracted from all refunds. 

If the Client cancels after beginning sessions and/or receiving services with Grace Possible, they may only request a refund for the amount pertaining to remaining sessions or hours not yet logged. The Client will not have the right to cancel or request a refund after the services have been fully performed (after all sessions or services have been completed). 

We reserve the right to modify or terminate services and the Client-Company relationship at any time for reasons such as, but not limited to, dangerous or criminal behavior on the part of the Client, inappropriate or offensive behavior from the Client, or irresponsible or disrespectful behavior from the Client. We will notify the Client with the reason for termination or modification and notice that it is effective immediately on the day that we contact the Client about modification or termination. In such situations, at the discretion of Griffin Coombs and The North Star Body, a refund may or may not be issued for any remaining sessions or services that were paid for but not completed.

All materials, electronic or otherwise, provided by Griffin Coombs or The North Star Body to the Client are permitted exclusively for personal use solely by the Client. The unauthorized sharing, duplication, reproduction, or sale of said materials by the Client to any personal or commercial entity is strictly prohibited and punishable by law. In the event that these terms are violated by the Client, Griffin Coombs and The North Star Body reserve the right to immediately terminate the Client-Company relationship by ceasing all services and denying refund of any services paid for by the Client and not completed.

These materials are intended for your personal use only. Please do not duplicate them or share them with anyone else, be it in a personal, professional, or commercial context. In the event that you do share, duplicate, or sell any of our client materials without authorization, we reserve the right to terminate our coaching relationship immediately, and you will forfeit any services that have been paid for but not yet completed. You are acknowledging that you will not receive a refund if you do violate these terms.
